The NAA goes to Washington Aerosol industry representatives urge lawmakers to consider economic impact of proposed ozone standards A group of industry stakeholders representing the National Aerosol Association (NAA) took to Capitol Hill on April 29 to call for congressional support for the Clean Air, Strong Economies (CASE) Act, which was reintroduced to both houses on March 17. The bill prohibits the U.S. Environmental Protection Agency (EPA) from lowering the National Ambient Air Quality Standards (NAAQS) until at least 85% of counties that were nonattainment areas as of Jan. 1, 2014 have attained compliance with the standard. It was introduced to the House of Representatives as H.R.1388 by Rep. Pete Olson (R-TX) and to the Senate as S.751 by Sen. John Thune (R-SD), and subsequently referred to committee in both houses. Sen. Joe Manchin (D-WV) was the bill’s first cosponsor in the Senate. If passed, the CASE Act would mandate that, in implementing a primary or secondary NAAQS for ozone, the EPA only determine a county to be a nonattainment area through direct air quality monitoring (not modeling), take into consideration the associated costs and burdens on businesses and include in the regulatory impact analysis for such a proposed rule at least one analysis that does not identify benefits resulting from reduced emissions of any pollutant other than ozone. The NAA’s support for the bill stems from a perceived lack of feasibility in the EPA’s proposed rulemaking lowering the current standard, an action the NAA considers premature.
