CARB The California Air Resources Board (CARB) has not released the 15-day comment notice needed to finalize the amendments to the Consumer Products and Aerosol Coating regulation (as we go to press). Some of the amendments that were adopted in September are needed now that 2014 has arrived. Remember, there were new limits that became effective on 12/31/2013. Changes to some of the lubricant categories in September affect the way the new limits will be applied. In the past, the CARB Enforcement Division has abided by the changes adopted by the board at the hearing, even though the Office of Administrative Law has not finalized the amendments. Hopefully, CARB staff will soon be able to finalize the amendments adopted by the CARB Executive Board in September 2013. LVP Research CARB continues with its research projects on low vapor pressure-volatile organic compounds (LVPVOCs). These projects are vital to the outcome of the status of numerous compounds that are used in the industry for all types of products, including personal care, automotive and household products. The industry needs to stay very involved in these studies and carefully monitor the results to ensure the research is relevant to our product usage. OTC On Dec. 4, 2013 The Ozone Transport Commission (OTC) petitioned the U.S. Environmental Protection Agency (EPA) to add the following states to the Ozone Transport Region (OTR): Illinois, Michigan, Tennessee, Indiana, North Carolina, Virginia, Kentucky, Ohio and West Virginia. OTC believes that air pollution from these states is contributing to the violation of the national ambient air quality standard. OTC is making the argument that many of the above states do not impose pollution controls as stringent as OTC. EPA has 18 months to approve or disapprove the petition. If EPA approves it, then we may see these states adopt the current OTC rules on consumer products. Green Chemistry Remember, the California Dept. of Toxic Substance Control (DTSC) has adopted the Safer Consumer Products regulation. We should start to see DTSC provide information on this regulation soon, hopefully by end of first quarter 2014. Weights & Measures Update On Jan. 9, the National Institute of Standards & Technology (NIST) held a meeting to discuss the current proposal in front of the National Conference of Weights & Measures (NCWM) for Bag-on-Valve (BOV) technology. At the meeting were representatives from these agencies, companies and associations: State & County Weights & Measures offices; NIST; Office of Weights & Measures; Federal Trade Commission; Food & Drug Administration; Environmental Protection Agency; Consumer Product Safety Commission; Measurement Canada; Canadian Food Inspection Agency; BOV Solutions; Beaumont Products; Proctor & Gamble; Wal-Mart; Energizer; Consumer Specialty Products Association and National Aerosol Association. The issue was whether BOV containers should declare their quantity by weight or volume. This has been an ongoing issue for several years. After four presentations and significant discussion, finally all party’s agreed that the Declaration of Quantity should be in weight. As we go to press, the next step will have been for the NCWM to move forward with its current proposal in late January at its mid-year meeting in Albuquerque, NM.
